Citation: At approximately 1830 hours I observed the following regulatory noncompliance in the evisceration department. The gizzard defatter machine's discharge pipe was not attached to the machine, and, as a result, there was a steady flow of waste water and gizzard fat from the opening of the machine directly onto the floor. Waste water was also leaking extensively out of the sides of the gizzard defatter machine onto the floor indicating that the cover was not sealed with an adequate gasket. The surrounding floor was extensively covered with the waste material. Evisceration Supervisor was notified of the insanitary condition. The missing discharge pipe was found underneath a sink a few feet away. 9CFR 416.2(e)(4) requires that plumbing systems must be installed and maintained to provide adequate floor drainage in all areas where normal operations release or discharge water or other liquid waste on the floor. 9CFR 416.4(b) requires that non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product. This document serves as written notification that your failure to comply with regulatory requirements may result in additional regulatory or administrative action.

Regulation:

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.2(e)(4) Provide adequate floor drainage in all areas where floors are subject to flooding-type cleaning or where normal operations release or discharge water or other liquid waste on the floor;

416.4(b) Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
