Citation: At approximately 1950 when I was walking through the plant I observed a tote without label on a pallet closed to the weight price cooler. I opened it and found a product of chicken thighs . I saw four more totes under the first one . I checked around them to see if any of the totes had labels. I saw two more of those had not any kind of identification. I pulled the lids off of the tops of each tote, but I did not find any identification. I took a regulatory control action by tagging the product with tag # B197812 and informed Mr. Second shift Manager with the noncompliance. they could not identify the lot number or the time of processing. the establishment started the corrective action and condemned the product found in the three totes without identification and the other two that were identified moved to the cooler. this is non compliance with 9 CFR 381.126.This document serves as written notification that continued failure to meet regulatory requirements can lead to enforcement actions described in 500.4.


381.126(a) Either the immediate container or the shipping container of all poultry food products shall be plainly and permanently marked by code or otherwise with the date of packing. If calendar dating is used, it must be accompanied by an explanatory statement, as provided in 381.129(c)(2).
