Citation: On 06/13/2011, at approximately 0515 hours, I notified Mr. (First Processing Manager) and Ms. (Quality Control Technician) that a light was out at the East pre-chill station. Ms. notified Mr. (maintenance third shift) that a light needed changed. At 1017 hours, I attempted to perform a pre-chill test when I noticed that the light had not been corrected. I requested from Mr. (Acting Maintenance Manager) that he send a maintenance employee to the USDA office with a light meter. I accompanied the maintenance employee to the pre-chill station to test the footcandle power at the station, the test revealed that there was only 150 footcandle power at the station which does not meet the requirements of 9 CFR 381.36 (2)(iv). I rejected the East Pre-chill testing station and applied US Reject tag # B40197856. At 1103 hours I released the East pre-chill station when the light had been replaced and footcandle power was found to exceed 200 footcandles of shadow free lighting. I notified Mr. and Mr. of this noncompliance and informed them that a NR would be issued for this noncompliance. The establishment has been notified both orally and in writing of this noncompliance.This is a violation of 9 CFR 416.2(c) and 9 CFR 381.36 2(iv). Failure to meet regulatory requirements could result in further administrative action as described in 9 CFR part 500.

Regulation:

416.2(c) Lighting of good quality and sufficient intensity to ensure that sanitary conditions are maintained and that product is not adulterated must be provided in areas where food is processed, handled, stored, or examined; where equipment and utensils are cleaned; and in hand-washing areas, dressing and locker rooms, and toilets.
