Citation: At approximately 0930 on 6/29/11, I was informed that a cadaver bird had been hung back on the PHV shackle. When I went to the stand to inspect the bird, it was not on the PHV hooks or any other hook at that station. I rang the bell and asked (Group Leader) where the cadaver bird was. She was unable to determine the carcass' whereabouts, but did determine that the inspector's helper had told one of the salvage employees not to take the bird from the shackle earlier. I informed of the noncompliance and failure to meet regulatory requirements. When the establishment still could not produce the bird, I condemned the product at salvage. I observed while the birds on the salvage stands were condemned and two red barrels partially filled with product were condemned. I also observed as the barrels and salvage tables were washed off. As per CFR 9 381.77, the identity of carcasses held back for further examination must be maintained until final examination has been completed. In addition, according to 381.90, all birds showing signs of having died from causes other than slaughter shall be condemned. The establishement must ensure that birds hung back on the PHV hook are not removed by plant employees and that adulterated product does not re-enter the flow of production. The establishment has received both oral and written notification of this noncompliance. Failure to meet regulatory requirements could result in additional enforcement action as described in 9 CFR part 500.


381.77 Each carcass, including all parts thereof, in which there is any lesion of disease, or other condition which might render such carcass or any part thereof adulterated and with respect to which a final decision cannot be made on first examination by the inspector, shall be held for further examination. The identity of each such carcass, including all parts thereof, shall be maintained until a final examination has been completed.
