Citation: On 07/06/2011, at approximately 1200 hours, I entered the Tray Pack/ Weigh Price cooler and observed at the rear of the cooler the door to the blast freezer was standing open. When I approached the door way, I observed an employee standing on the sides of two of the stacks of freezer trays. The stacks contained tray wrapped Boneless/ skinless breast meat. I took immediate regulatory control action by placing US Retain tags #B40197862 and #B40197861 on the two stacks of product. I notified Ms. (Tray Pack Supervisor) of the noncompliance. I also notified Mr. (QA Manager) and Mr. (Further Processing Manager) of this noncompliance and that a NR would be issued. This is a violation of 9 CFR 416.1 and 9 CFR 416.4(d). Given the observation of the employee standing on the freezer baskets with his boots touching the tray wrapped product on the baskets, product adulteration was highly imminent. The establishment has received both written and oral notification of this noncompliance. Failure to meet regulatory requirements could result in additional administrative action as described in 9 CFR part 500.
416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.
416.4(d) Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishments.
