Citation: On 7/13/11 at approximately 0901 hours, I performed a presentation verification (ISP code 06D02) at the second inspection station on the evisceration lines, at a line speed of [redacted] birds per minute (bpm). The East line passed the presentation test. At 0920, at the first station of the West line, presentation failed with a 10 bird total nonconformance weight of [redacted], which requires a retest by QA. This failure consisted of 1 viscera not uniform (8 nonconformance factors each), 2 viscera on shackles (8 nonconformance factors each), and 2 contamination inside bird (6 nonconformance factors each.). I immediately informed who notified QA, of the establishment's failure to meet regulatory requirements. During the retest at 0932, the establishment failed with a nonconformance weight of [redacted]. The line speed was dropped to [redacted] bpm. During subsequent failures the line speed was progressively reduced to [redacted] bpm. The establishment then began to pass the retests until the line speed was returned to [redacted] bpm and able to pass the presentation test at that speed, at approximately 1300 hours. Establishment mnagement has recieved oral and written notification regarding this noncomplicance. Continued failure to comply with regulatory requirements could result in additional enforcement action as described in 9 CFR 500. Regulation:

381.76(b) The Administrator determines that the establishment has the intent and capability to operate at line speeds greater than 70 birds per minute, and meets all the facility requirements in 381.36(d).
