Citation: On November 3rd, 2011, at approximately 0816 hours, I was performing a presentation verification (ISP Code 06D02) at the first inspection station on the West Evisceration line, at a line speed of [redacted] birds per minute (bpm). Presentation failed with a 10 bird nonconformance weight of [redacted] membrane and a total of [redacted] nonconformance weights. This failure consisted of 1 contamination on viscera (6 nonconformance factors each), 5 membranes (2 nonconformance factors each), 1 opening cut (1 nonconformance factor each), 1 parts inside (1 nonconformance factor each), 1 contamination inside bird (6 nonconformance factors each). I notified Evisceration Supervisor of my findings and asked that he notify QA Tech of the establishments failure to meet regulatory requirements. QA performed presentation retests which failed at 0825, 0836, & 0854, USDA determined that the line speed would remain at [redacted] bpm until the lot change, at 1004 ([redacted] bpm), 1025 ([redacted] bpm), 1113 ([redacted] bpm) retest passed, retests failed again at 1129 at ([redacted] bpm), 1149 ([redacted] bpm), at lot change at1224 ([redacted] bpm) & at 1406 ([redacted] bpm). At approximately 1241 hours, I was performing a presentation verification (ISP Code 06D02) at the third inspection station on the East evisceration line, at a line speed of [redacted] birds per minute (bpm). Presentation failed with a 10 bird nonconformance weight of [redacted] plus three occurrences of one error. This failure consisted of 3 contamination on viscera (6 nonconformance factors each), 1 parts inside (1 nonconformance factors each), 1 contamination inside bird (6 nonconformance factors each). I notified of my findings and asked him to inform QA Tech of the establishments failure to meet regulatory requirements. QA performed retests and failed at 1247 ([redacted] bpm), 1258 ([redacted] bpm), 1309 ([redacted] bpm). Establishment management has received oral & written notification regarding this noncompliance. Failure to comply with regulatory requirements could result in additional enforcement action as described in 9 CFR 500.

Regulation:

381.76(b) Presentation: Each inspector shall be flanked by an establishment employee assigned to be the inspector’s helper. The one inspector on the SIS–1 line shall be presented every bird. Each inspector on the SIS–2 line shall be presented every other bird on the line. An establishment employee shall present each bird to the inspector properly eviscerated with the back side toward the inspector and the viscera uniformly trailing or leading. Each inspector shall inspect the inside, viscera, and outside of all birds presented.
