Citation: At approximately 1155 hours, while performing a 04C04 ISP Code procedure for Finished Product Standards (Processing/Trims Nonconformance) Test at the Pre-chill Station) on the East Evisceration Line, my test exceed the absolute limit of 30, the FPS for Processing Category on the test was not in the absolute limit.. My test results subgroup total was 38, the processing nonconformance's were two (2) extraneous material <, one (1) extraneous material>1/16, one (1) extraneous material>1", one (1) oil glands-two whole glands, two (2 lung) >1/4, two (2) lung-whole, one (1) cloaca, one (1) Bursa of Fabricius, one (1) crop-whole, one (1) trachea < 1'. One (1) trachea >1", six (6) feathers and/or pinfeathers, and two (2) Long shank- Both condyles covered. I immediately notified (Quality Assurance) of my findings. (1st Processing Superintendent) was informed of my findings. Quality Assurance performed a retested for Finished Product Standard processing nonconformance's on the east evisceration line at 1207 hours for processing nonconformance's and failed the retest with a result of 36 with exceeded the tolerance for processing category, and placed the east evisceration line in action mode. I informed (Eviscerating Supervisor) and (SCSI) of the results. There was no post chill test perform using prechill criteria until the chicken carcasses exited the chilling at 1200 hours (Company Break for Packing Department). Quality Assurance performed a retested for Finished Product Standard processing nonconformance's on the east evisceration line at 1223 hours for processing nonconformance's and failed the retest with a result of 26 with exceeded the tolerance for processing category. Quality Assurance performed one retested for Finished Product Standard on the east evisceration line at 1242 hours and test pass. At approximately 1245 hours, the last poultry carcasses for today operation passed the east pre-chill station marking the end of the failure mode. Quality Assurance performed retest for processing nonconformance at the post chill station using prechill criteria, and pass at approximately 1232 hours, and 1309 hours. Quality Assurance performed Finished Product Standard for processing nonconformance's at the post chill station using prechill criteria's and failed the retest with a result of 26 with exceeded the tolerance for processing category. Quality Assurance performed retest for processing nonconformance at the post chill station using prechill criteria, and pass at approximately 1352 hours. At approximately 1421 hours, the last poultry carcasses exited the chiller marking the end of the failure mode. I retained approximately 500 whole poultry carcasses for reworks with US Retained Tag B39 133557 and B39 801168 with three (3) QA Retained Tag 4935, 4378 and 4379 for three (3) combo bins. This document serves as a written notification that your failure to comply with regulatory requirement could result in additional enforcement action described in 9 CFR part 500. Past Similar NRs - Previous Ineffective Plant Actions: See establishment response to this noncompliance. Establishment corrective actions were ineffective to prevent this recurrence of this noncompliance. NR: 140-2011 dated 11/11/2011

Regulation:

381.76(b) Disposition: An inspector shall monitor the establishment’s application of the Finished Product Standards program and shall take corrective action including retaining product to prevent adulterated product from leaving the establishment when the inspector determines that the establishment has failed to apply the program as prescribed in paragraph (b)(3)(iv)(c) of this section).
