Citation: At approximately 1350 hours, while performing a Net Weight procedure on Penn Valley Farms Chicken Wings with Julian date of 060, Label Code 00122, label time various hours, labeled 40 lb. each, and were randomly selected. I observed (Quality Assurance) weighing the boxes, four (4) boxes of Chicken Wings out of ten (10) boxes of Chicken Wings failed to meet the requirements of 381.121. The four (4) boxes did not meet the underweight limit of .40 lbs (1%) per container had the following weights were 39.30 pound, 37.90 pound, 39.30, and 38.85 pound. Upon further examination, there were a total of seventeen (17) boxes of Chicken wings (After examined the products in the cooler and scale). I informed (Quality Assurance Manager) and (Cut-Up Supervisor) of my finding. I took regulatory control on the seventeen boxes of Chicken Wings with US Retained Tag B40 170379. Establishment management has received oral and written communication concerning this noncompliance. This document serves as a written notification that your failure to comply with regulatory requirement could result in additional enforcement action described in 9 CFR part 500.
381.121(b) When a poultry product and a nonpoultry product are separately wrapped and are placed in a single immediate container bearing the same name of both products, the net weight on such immediate container may be the total net weight of the products, or such immediate container may show the net weights of the poultry product and the nonpoultry product separately. Notwithstanding the other provisions of this paragraph, the label on consumer size retail packages of stuffed poultry and other stuffed poultry products must show the total net weight of the poultry product, and in close proximity thereto, a statement specifying the minimum weight of the poultry in the product.
