Citation: At approximately 1508 hours, 03/01/2012, I observed approximately a one foot long intestinal track hanging from a poultry carcass on the transfer line at the grading belt area in the Packing Department. I found two drops of fecal material located on the right upper portion of the wing approximately 1/8 inch and 3/32 inches in diameter. The giblet was attached with the one foot long intestine. The fecal material was brownish-green in color with a pasty consistency. I then performed a HACCP verification procedure for the specific lot (Lot#4) for all CCPs plus the preshipment review. Upon further examination, in the establishment Hazard Plan, dated 12-22-2011, signed by Director of Quality Assurance, under the Evisceration through Chiller Hazard Analysis and Critical Control Point System, establishment had not identified fecal material to be a hazard in its hazard analysis at the post chill station or poultry carcasses exiting the chiller system. In the HACCP Flow Chart for Evisceration through Chiller shows [redacted]. [redacted]. Establishment on line reprocess system was not effective to remove the giblet with intestine from the poultry carcass. Establishment employees at the grading table failed to remove the giblet with intestine before hanging the carcass on the transfer line. I also observed a yellow condemn barrel at establishment grading table with approximately forty to sixty giblet with intestine doing my findings of cross contaminated carcass. Which indicate the establishment is not adequately controlling it's slaughter process with affected intestinal entering into the chill system. The finding of fecal material at the grading table, and transfer line is an unforeseen hazard. The establishment may wish to reassess the hazard analysis in response to this unforeseen hazard. Establishment record indicates that a test at the Post Chill Station at approximately 1430 hours was not performed by Quality Assurance. If the test was performed at this time, product involved with noncompliance record 1003216032101N, dated 3/12/12, would had been from 1430 hours to 1518 hours, and not 1244 hours to 1518 hours. Establishment should perform all procedure as indicated in the program. Establishment management has received oral and written notification concerning this noncompliance. This document serves as written notification that your failure to prevent the food safety hazard of fecal contamination could result in additional enforcement action as per described in 9 CFR part 500.

Regulation:

381.76(b) Presentation: Each inspector shall be flanked by an establishment employee assigned to be the inspector’s helper. The one inspector on the SIS–1 line shall be presented every bird. Each inspector on the SIS–2 line shall be presented every other bird on the line. An establishment employee shall present each bird to the inspector properly eviscerated with the back side toward the inspector and the viscera uniformly trailing or leading. Each inspector shall inspect the inside, viscera, and outside of all birds presented.

417.3(b)(3) Take action, when necessary, with respect to the affected product to ensure that no product that is injurious to health or otherwise adulterated, as a result of the deviation, enters commerce;
