Citation: On June 6, 2012, at approximately 1338 hours, while performing a Net Weight procedure on Coleman Organic Young Chicken Boneless Skinless Thigh ( with Julian date of 158, Label Code 30304, label time various hours, labeled (Packed Weight) 50 lb. to 51 lb. each, Tare Weigh 1.45 lbs, and were randomly selected.  I observed and  (Quality Assurance) weighing the boxes, four (4) boxes of Boneless Skinless Chicken Thighs out of ten (10) boxes of Boneless Skinless Chicken Thighs failed to meet the requirements of 9 CFR 381.121. The four (4) boxes did not meet the underweight limit of (1%) per container had the following weights; Packed Weight  (PW) 50.75 pound with Actual Weight (AW) 50.15 pound,  (PW) 50.25 pound with (AW) 49.70 pound, (PW) 50.65 pound with (AW) 49.55 pound, and (PW) 50.70 pound with (AW) 50.10 pound..  Upon further examination, there were a total of twenty-three (23) boxes of Boneless Skinless Chicken Thighs (After examined the products in the Thigh Deboning Department and scale). I informed (2nd Processing Superintendent) of my finding.  I took regulatory control on the twenty-three boxes of Boneless Skinless Chicken Thighs with US Retained Tag B40 170345. Establishment management has received oral and written communication concerning this noncompliance. 

Regulation:

381.121(a) The label shall bear a statement of the quantity of contents in terms of weight or measures as provided in paragraph (c)(5) of this section. However, the Administrator may approve the use of labels for certain types of consumer packages which do not bear a statement of the net weight that would otherwise be required under this subparagraph: Provided, That the shipping container bears a statement ‘‘Net weight to be marked on consumer packages prior to display and sale’’: And provided further, That the total net weight of the contents of the shipping container is marked on such container: And provided further, That the shipping container bears a statement ‘‘Tare weight of consumer package’’ and in close proximity thereto, the actual tare weight (weight of packaging material), weighed to the nearest one-eighth ounce or less, of the individual consumer package in the shipping container. The above-specified statements may be added to approved shipping container labels upon approval by the inspector in charge.
