Citation: At approximately 1145 hours, while performing a Net Weight procedure on Coleman Organic Young Chicken Breast Trimming w/Bones ( with Julian date of 161, Label Code 07166, label time various hours, labeled (Packed Weight) 50 lb. to 51 lb. each, Tare Weigh 1.45 lbs, and were randomly selected.  I observed (Quality Assurance) weighing the boxes, three (3) boxes of Breast trimming w/Bones out of ten (10) boxes of Breast trimming w/Bones failed to meet the requirements of 9 CFR 381.121. The three(3) boxes did not meet the underweight limit of (1%) per container had the following weights; Packed Weight  (PW) 50.30 pound with Actual Weight (AW) 49.20 pound,  (PW) 49.00 pound with (AW) 45.15 pound, and (PW) 50.25 pound with (AW) 48.25 pound..  Upon further examination, there were a total of twenty-seven (27) boxes of Breast Trimming w/Bones (After examined the products in the Breast Deboning Department and scale). The Breast Deboning Label Scale # 14-1 shows a Tare Weigh 1.35 pound, not 1.45 pound for a forty pound box w/ plastic bag. I informed (Further Processing Superintendent) of my finding.  I took regulatory control on the twenty-seven (27) boxes of Coleman Organic Young Chicken Breast Trimming w/Bone with US Retained Tag B40 801097. Establishment management has received oral and written communication concerning this noncompliance. 

Regulation:

381.121(a) The label shall bear a statement of the quantity of contents in terms of weight or measures as provided in paragraph (c)(5) of this section. However, the Administrator may approve the use of labels for certain types of consumer packages which do not bear a statement of the net weight that would otherwise be required under this subparagraph: Provided, That the shipping container bears a statement ‘‘Net weight to be marked on consumer packages prior to display and sale’’: And provided further, That the total net weight of the contents of the shipping container is marked on such container: And provided further, That the shipping container bears a statement ‘‘Tare weight of consumer package’’ and in close proximity thereto, the actual tare weight (weight of packaging material), weighed to the nearest one-eighth ounce or less, of the individual consumer package in the shipping container. The above-specified statements may be added to approved shipping container labels upon approval by the inspector in charge.
