Citation: At approximately 1617 hours during plant operations I observed the following noncompliance in the cooler area. I observed water dripping from the ceiling in 6 (six) different locations above the product stored in the cooler. The water was dripping on to the product below. I immediately informed Mr. of my findings and applied USDA tag # B39801786 to 20 ,40 Lb. boxes of Whole Chicken (code 20428) and 1 combo of Chicken Thighs(00005) all dated 7/21/2010. All the boxes and combo bins were removed from the affected area. The dripping water didn't contaminate any of the product because the box lids are sealed and plastic was over the combo of thighs at the moment of my observation. The lids were removed and replaced with new ones and the plastic was removed from the combo and replaced. Plastic was hung as a temporary Fix and sanitary conditions were restored at that time. I removed my tag at1700 hours. This is in violation of CFR 416.1,416.2(b)(1) 416.4(d) Past Similar NRs - Previous Ineffective Plant Actions: condensation NR: 42-2010 dated 7/19/2010
416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.
416.2(b)(1) Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions.
416.2(d) Ventilation adequate to control odors, vapors, and condensation to the extent necessary to prevent adulteration of product and the creation of insanitary conditions must be provided.
