Violation: 416.2(a), 416.4(b)

Citation: At approximately 0651 hours, after plant's pre-operational sanitation and prior to the start of operation, while performing (01B02) pre-op sanitation procedure the following noncompliance was observed in the Cut- Up department. I observed mold on the surface of the electrical yellow cables of the light near the entry/exit of the cut-up department and the four lights over the working stainless steel table. I also observed mold on three black and one white vacuum system cables that are tight together over the incline belt from packing. I observed mold on the electrical gray pipe and square cover box connected to this pipe located on the ceiling on front of the cooling unit near the east wall. I informed (Second Processing Manager) of my observation. A review of the plant's pre-op operational and operational form# 6 cut-up showed no deficiencies prior to my observation. This is a failure to comply with regulatory requirement 9CFR 416.2(a) and 416.4(b). This developing trend was discussed in the weekly meeting with plant management on 04/16/2010; 05/21/2010; 07/02/2010. Past Similar NRs - Previous Ineffective Plant Actions: Sanitation Manager was notified. Mold will be removed by 5/22/2010 NR: 24-2010 dated 5/17/2010 The previous preventive measure was either not implemented or was ineffective in preventing the recurrence of this noncompliance. Failure to comply with regulatory requirement could result in additional enforcement action described in 9CFR part 500.4.

Regulation:

416.2(a) Grounds and pest control. The grounds about an establishment must be maintained to prevent conditions that could lead to insanitary conditions, adulteration of product, or interfere with inspection by FSIS program employees. Establishments must have in place a pest management program to prevent the harborage and breeding of pests on the grounds and within establishment facilities. Pest control substances used must be safe and effective under the conditions of use and not be applied or stored in a manner that will result in the adulteration of product or the creation of insanitary conditions.

416.4(b) Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
