Violation: 416.3(a), 416.4(d)

Citation: At approxminately 0604 hours, while observing the start up of the evisceration department, I observed that the sprayers on the Combo Vac machine at the exit side of the machine were spraying water on to the line, rail, wheels and the chain, as well as the supports for the machine and rail. The water was dripping off of the supports on to areas that would be product contact surfaces. I took regulatory control by stopping the evisceration line and notified Ms. of the noncompliance. I remained in the area until the noncompliance was corrected and I released the evisceration line to production. This concern had been discussed previously with the establishment on 08/09/2010. This is a failure to comply with 9 CFR 416.3(a) &416.4(d). Failure to comply with regulatory requirements could result in additional enforcement action as described in 9 CFR 500.

Regulation:

416.3(a) Equipment and utensils used for processing or otherwise handling edible product or ingredients must be of such material and construction to facilitate thorough cleaning and to ensure that their use will not cause the adulteration of product during processing, handling, or storage. Equipment and utensils must be maintained in sanitary condition so as not to adulterate product.

416.4(d) Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishments.
