Citation: As result of an ongoing FSA(Food Safety Assessment) conducted at this plant the following condition was brought to the attention of IPP The plants HACCP plan does not delineate the separation of tongues derived from inspected products(keystone) and tongues derived from ducks produced under your religious exemption (buddhist, confusion style) these birds by their nature are not eligible to receive the mark of inspection. It is the USDA policy divisions stance that tongues produced from carcasses that are not eligible to bear the mark of inspection cannot be co mingled with tongues that are. Once commingling does occur none of these tongues are now able to receive the mark of inspection and this becomes a violation of Reg 9 CFR 381.129(a) No poultry product subject to the Act shall have any false or misleading labeling or any container that is so made, formed, or filled as to be misleading. However, established trade names and other labeling and containers which are not false or misleading and which are approved by the Administrator in the regulations or in specific cases are permitted.(b) No statement, word, picture, design, or device which is false or misleading in any particular or conveys any false impression or gives any false indication of origin, identity, or quality, shall appear on any label.

Regulation:

381.129(a) No poultry product subject to the Act shall have any false or misleading labeling or any container that is so made, formed, or filled as to be misleading misleading. 381.129(b) No statement, word, picture, design, or device which is false or misleading in any particular or conveys any false impression or gives any false indication of origin, identity, or quality, shall appear on any label.
